Any personal
representative,
trustee, or
guardian may be required to
purchase or furnish a bond while
serving.
Pennsylvania does not automatically require resident personal
representatives to provide a bond. However, unless the
will expressly excuses the requirement, personal representatives who are
not Pennsylvania residents are required to furnish a bond. Trustees
and guardians are also not required to furnish a bond, unless it is required
by the document that makes the appointment of that role.
Without regard to any of these conditions, the
Orphans' Court has the
discretion to require a bond at any time that it determines a bond is
necessary to protect the assets under that party's control.
