Executor, Ineligibility
Any minor or
incompetent individual will be
ineligible to serve as the
executor. Any person charged with
the death of the testator is also
ineligible to serve, until he or she is found not guilty of the crime or the
charge is dismissed.
The Orphans' Court also has the
power to remove any executor when the
fiduciary obligations to the
estate are not being satisfied, such
as when the estate's property is being mismanaged.
Although not ineligible, any person or
entity nominated to serve as executor may simply choose not to accept
the position. Any executor may also accept the position and then later
resign by notifying the Register
of Wills in writing at any time.
