Durable Power of Attorney
A Power of Attorney that does not expire when the principal becomes incapacitated or incompetent.

Historically, a Power of Attorney could only grant the same authority that the principal could exercise independently and when the principal was no longer capable of acting, the agent could not act.

All Powers of Attorney, durable or otherwise, immediately expire upon the principal's death.
