A condition in which a individual provided with appropriate medical information is: 1) unable to understand the potential benefits, risks and alternatives involved with a specific proposed health care decision; or 2) unable to make that health care decision on his or her own behalf; or 3) unable to communicate that health care decision to any other person.
The existence of this condition must be documented by a health care provider.
