Penalty Clause
A will provision that eliminates or reduces the
amount of a
testamentary gift if the named
beneficiary of that gift contests the will.
For Example:
"I give $5,000 to my son Bob and $500 to my son John, but if John contests
my will, I give $5,499 to Bob and $1 to John."
Pennsylvania does not enforce penalty clauses against any person with
probable cause to contest the will.
