Survival
Any person living at the time of a
decedent's death is said to "survive" the decedent.
Survival is most often used to determine a
beneficiary's eligibility to receive
testamentary gifts. Survival is also used to determine the appropriate
appointment to fiduciary
positions, such as
executor and
trustee, as well as the disposition of
life insurance proceeds
and
joint property owned with
the right of survivorship.
