Living Will, Liability For Compliance
Pennsylvania protects
health care providers from legal liability for following, in good faith,
the terms of a valid
living will.
This removes a potential barrier to compliance with living wills, which
might otherwise be viewed as a likely source of litigation against health
care providers. However, this does not change the obligation to adhere
to professional standards or excuse negligence in the manner in which the
expressed wishes are carried out.
