Mental Health Living Will Contact Person,
Generally
Pennsylvania's mental
health living will laws allows the
declarant to name a contact person. The contact person is someone
you wish to have notified of your location if your mental health living will
becomes effective. This person is only to be notified of your location
and will only be given this information if you are deemed incapable of
making personal
mental health care
treatment decisions.
This may occur both before or after your admission to a treatment facility,
depending upon when it is determined that you are incapable of making mental
health care treatment decisions. For the same reason, it may not occur at
all.
For Example:
Randall's mental health living will lists his sister, Mildred, as his
contact person.
Randall voluntarily admits himself to The Bromden Hospital for mental health
treatment at a time when he is capable of making mental health care
decisions. Because Randall is still capable of making mental health care
decisions, his mental health living will is not followed and his sister is
not notified of his admission to the hospital. Randall is later discharged
without his sister knowing of his admittance.
Now suppose that Randall admits himself in June, still capable of making
mental health care decisions, and in July he is deemed incapable of making
mental health care decisions. In this instance, Mildred will be notified of
Randall's presence at The Bromden Hospital and the hospital's location.
The same is true if Randall is ever
involuntarily committed
for mental health treatment while incapable of making mental health care
decisions, Mildred will similarly be notified of his commitment and the
treatment facility's location.
