Mental Health Living Will, Generally
A mental health living
will is a legal document that instructs
mental health care
providers of the declarant's
wishes for the initiation, continuation, or refusal of specific forms of
mental health treatment,
which is to be followed during times when the declarant lacks the competence
to personally communicate this type of information.
A mental health living will can provide the declarant's personal preferences
about receiving specific types of medical treatment, such as
electroconvulsive therapy or
medications. The declarant may also name a preferred treatment facility, as
well as a facility that is not preferred.
A mental health living will may also be used to nominate a personal
guardian of the person
and/or guardian of the estate
for consideration by the
Orphans' Court if the declarant
is later found to be
incapacitated and in need of a
guardian.
