Power of Attorney, Delivery
Upon completion and proper execution,
a
power of attorney may be
immediately delivered to the agent who
is named by the document.
In order to exercise the powers that are granted by the power of attorney,
the agent must have the ability to provide the document to anyone who is to
honor his or her authority.
Delivery to the agent is not required, provided that the agent has access to
the document when necessary. The
principal may keep the document in any location and personally provide
it to the agent when it is needed or ensure that the agent knows of its
location and has the ability to access that location when the document is
needed.
It is also important to note that safe deposit boxes may only be accessed by
a joint owner. If a power of attorney is placed in a safe deposit box that
is registered solely in the name of the principal, the principal is the only
person with the ability to access that box and remove the document.
