Primary Beneficiaries, Deceased
Each deceased primary
beneficiary's share of the
residuary estate will be distributed according to how many general
residuary
alternate beneficiaries named.
One Alternate Beneficiary
All of the property intended for every deceased
primary beneficiary is added together and given to the sole
alternate beneficiary.
Multiple Alternate Beneficiaries
All of the property intended for every deceased
primary beneficiary is added together and then divided among all of the
alternate beneficiaries.
No Alternate Beneficiaries
If there aren't any alternate beneficiaries, the individual share of each
deceased primary beneficiary
is:
1. Divided among the remaining, living primary beneficiaries.
2. Divided among the heirs of each deceased
primary beneficiary on a
per stirpes basis.
3. Distributed according to Pennsylvania's Anti-Lapse laws or intestacy
laws, when neither of the above two options are chosen.
