Sound Mind, Generally
Also known as "testamentary capacity,"
sound mind describes the mental condition that a
testator must possess at the time of the
will's
execution. Although there may be certain variations in the exact
definition of this concept, Pennsylvania generally requires each testator to
have a basic understanding of:
1. The property that he or she owns.
2. The people who are the
natural objects of the testator's bounty.
3. What the testator wants to be done with his or her property after death.
4. How these elements relate to each other in the plan formed by the will.
Although satisfying all of these factors will not guarantee the presence of
sound mind, the absence of just one may cause a will to be invalid based on
a lack of sound mind.
