Trustee, Eligibility
Any competent adult may be nominated to serve as the
trustee of any
testamentary trusts
formed by a will. The nominated
trustee is not required to have a family relationship with the settlor or
any of the trust beneficiaries.
A trustee is also not required to be a Pennsylvania resident. However, the
Orphans' Court has the
authority to appoint a Pennsylvania resident as the co-trustee of any trust
that does not have an existing resident trustee.
Entities, such as banks, are also
permitted to serve, but must meet specific requirements to assume the role.
Also, although an entity may be authorized to act, each entity has different
standards for accepting the role of trustee, such as the estimated
compensation or complexity of the trust.
